All rights, including copyright, on this website are owned by The Late Brake Show. Any use of the site or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without prior permission.

By placing an order you are agreeing to purchase a product according to the following terms and conditions.

All the information we provide on our shop is an accurate as we can make it. Any errors are unintentional and we will correct errors as quickly as possible.

We have tried to put as much detail as possible for each product listed, so please read each product description carefully before committing to buy. Doing this will prevent the need for unnecessary returns.

Prices for our products are subject to change, in line with our suppliers costs to us, and we will do our best to notify anyone affected by price changes as quickly as possible.

Delivery costs will be charged in addition to the goods sold and are confirmed during the checkout process.

Product care is the responsibility of the purchaser. Please be mindful of how you care for our items once received. All items are sourced as environmentally-friendly as possible, meaning they may not have the same wear and tear as some more generic brands. That said, with the correct care they should last you for a good while.

We may, from time to time, offer promotional discount codes. The conditions of use will be specified at the time of issue. Please read these carefully!

Promotional codes can only be used once per person, and must be used in accordance with the conditions stated (and in the spirit they are intended). But just to be clear:

· A promotional code cannot be used after an order has been placed.
· You cannot swap your promotional code for cash.

Please note, we cannot guarantee to be able to amend orders, once placed, but will always do our best. We definitely won’t be able to change any orders after 5pm on a Friday.

Specific Sales Terms


When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until your payment has been approved and we have debited your credit or debit card.

Oh and it sounds mean, but we need to say it… We reserve the right, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

SHOPIFY


Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

UK Consumer Rights

If you are a consumer purchasing from the United Kingdom, your statutory rights are governed by applicable UK consumer protection legislation, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Your Right to Cancel

For most online purchases, you have the right to cancel your order within 14 days of receiving the goods without giving any reason. To exercise this right, you must notify us of your decision to cancel within the cancellation period.

Once you have notified us of your decision to cancel, you must return the goods to us within 14 days. Unless the goods are faulty or we have agreed otherwise, you are responsible for the direct cost of returning the goods.

The right to cancel does not apply to goods made to your specifications, clearly personalised products, or other categories of goods excluded by law.

Faulty, Damaged or Incorrect Goods

Under the Consumer Rights Act 2015, all goods supplied by us must be:

  • of satisfactory quality;

  • fit for their intended purpose; and

  • as described.

If goods fail to meet these requirements, you may be entitled to statutory remedies.

If a fault is reported within 30 days of delivery, you may be entitled to reject the goods and receive a full refund.

If a fault develops after 30 days and within the first six months after delivery, we may offer a repair or replacement in accordance with your statutory rights. If a repair or replacement is unsuccessful, you may become entitled to a refund or price reduction as provided by law.

Nothing in these Terms excludes, limits or restricts any rights or remedies that you may have under applicable consumer protection legislation.

Relationship with Our Returns Policy

Any voluntary returns policy offered by The Late Brake Show is provided in addition to, and does not replace, your statutory rights under UK consumer law.


EU Consumer Right of Withdrawal

If you are a consumer residing in the European Union and have purchased goods from us through our website, you have a statutory right to withdraw from your purchase within 14 days without giving any reason.

The withdrawal period will expire 14 days after the day on which you, or a third party indicated by you (other than the carrier), acquire physical possession of the goods. Where an order consists of multiple goods delivered separately, the withdrawal period will expire 14 days after receipt of the final item.

To exercise your right of withdrawal, you may submit a withdrawal request using the online withdrawal function available.  

Upon receipt of your withdrawal declaration, we will send you an acknowledgement of receipt by email without undue delay.

If you withdraw from the contract within the statutory withdrawal period, we will reimburse all payments received from you in relation to the cancelled order, including the cost of standard delivery (where applicable under law), no later than 14 days after we receive the returned goods or satisfactory evidence that the goods have been returned, whichever occurs first.

Refunds will be made using the same payment method used for the original transaction unless expressly agreed otherwise.

You must return the goods to us without undue delay and, in any event, no later than 14 days after notifying us of your withdrawal. Unless the goods are faulty or we have agreed otherwise, you will be responsible for the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The statutory right of withdrawal does not apply to goods made to a consumer's specifications or clearly personalised, sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed, or any other products excluded from the right of withdrawal under applicable consumer protection legislation.

The statutory EU right of withdrawal and online withdrawal function described in this policy apply only to consumers who are entitled to those rights under applicable European Union consumer protection legislation. Customers purchasing from the United Kingdom are subject to applicable UK consumer protection laws and our standard returns policy unless otherwise stated.

This statutory right of withdrawal is separate from and in addition to any goodwill returns policy offered by The Late Brake Show.
